AmberAds Terms of Service & Privacy Policy

1. Introduction

This document outlines the Terms of Service and Privacy Policy governing the use of the AmberAds platform.

By accessing or using any part of the AmberAds platform, you automatically accept and agree to the provisions set forth herein. If you do not agree to these terms, you are not authorized to use the service.

2. Platform Description

AmberAds is a platform designed to facilitate advertising within the Telegram audience. Advertisers initiate campaigns by defining targeting, budget, and content. Based on this input, the AmberAds platform autonomously generates offers and distributes them to selected Telegram publishers based on criteria such as audience size, category, engagement metrics, and other internal parameters.

The platform itself is accessed via web or Telegram-based interfaces. However, all advertisements are published exclusively within the Telegram platform.


3. User Roles and Registration

AmberAds operates with two distinct user roles:

  • Advertisers: Entities or individuals that create advertising campaigns to promote their own or third-party products or services.
  • Publishers: Owners of Telegram channels who agree to publish sponsored content as part of the platform’s offer system.

To register an account, users must provide a valid and verifiable email address. By registering, users confirm they are at least 16 years of age and that the information provided is accurate and complete.


4. Offer Mechanism and Financial Terms

Once a campaign is created by an advertiser, the platform processes the campaign data and generates offers to eligible publishers. Publishers may choose to accept or ignore these offers.

Upon acceptance of an offer by a publisher:

  • The corresponding budget amount is frozen and cannot be refunded under normal conditions.
  • Funds are held until the advertisement is executed in accordance with the platform's guidelines.
  • Refunds will only be issued in cases where the publisher demonstrably violates posting conditions, such as:
    • Failing to publish the ad,
    • Modifying the content without authorization,
    • Removing the ad prematurely before the end timestamp,

All other cases are considered final, and the platform retains the right to determine refund eligibility solely at its discretion.

5. Publisher Requirements

To enable offer delivery and ad publishing:

  • The publisher must add the official AmberAds Telegram bot and the official AmberAds Telegram user account as administrators of the channel intended for ad placement.
  • These admin permissions must be restricted to the minimal level required for offer validation and post verification.
  • The channel may be public or private. However, administrative access for both bot and platform account is mandatory for participation.

In order to operate the AmberAds platform and validate advertisement delivery, the official AmberAds Telegram bot may perform the following actions within a connected Telegram channel:

  • Publish and remove advertisement posts
  • Collect engagement metrics (such as views, reactions)
  • Validate post presence and timing

    These actions are strictly limited to platform-related operations. The bot does not perform any unrelated administrative or content functions.


6. Data Collection

AmberAds collects and processes the following categories of data:

Data Provided by Users:

  • Email address (for registration and communication purposes)
  • Role (advertiser or publisher)
  • Campaign or channel-related data voluntarily submitted during use of the platform
  • Other data provided by the user ( publisher or advertiser )

Data Collected via Telegram:

  • Telegram user identifiers, usernames, and public profile information
  • Telegram channel metadata, including:
    • Channel name, member count, engagement metrics (views, reactions)
    • Content themes and publication frequency
  • Information from both public Telegram channels and private channels connected to the platform by publishers

Data from Analytics Providers:

  • IP address, browser type, device information
  • Referrer URLs and general location data
  • On-site behavioral data (e.g., session length, clicks, pages accessed)

7. Data Usage

Collected data is used for the following purposes:

  • Platform functionality (account authentication, campaign execution, etc.)
  • Analytical evaluation of publisher channels and audiences
  • Platform’s algorithm improvements
  • Internal metrics, reporting, and fraud prevention
  • Infrastructure and security monitoring
  • Generate and display anonymized aggregate reports to users regarding advertising metrics and campaign trends
  • Share non-personal, anonymized statistical data with third parties, including potential partners, researchers, or market analysts

8. Use of Publicly Available Data

AmberAds may collect and process data from public sources, particularly public Telegram channels and user profiles, to improve its internal analytics and algorithms.

This information is collected in accordance with the source platform’s public access policies.

9. Audience Analysis of Connected Channels

When a publisher connects a Telegram channel to the platform, AmberAds may automatically analyze:

  • Follower counts and growth trends
  • Post reach and interaction levels
  • Content consistency and category alignment

AmberAds may analyze information accessible to the administrator of a connected Telegram channel (such as audience metrics, activity levels, or posting history) in order to assess channel performance and improve service quality. This analysis is limited to data legitimately available to the publisher through the Telegram interface.

Such analysis is used solely for offer qualification and pricing calibration. No direct communication is made with the channel's followers or audience

10. Third-Party Services

AmberAds may integrate with third-party services such as:

  • Google Analytics
  • Yandex Metrica

These services may collect data through cookies and tracking scripts. By using AmberAds, users agree to the processing of their data by such providers in accordance with their respective privacy policies.


11. Data Retention Policy

AmberAds retains personal data only for as long as it is needed to fulfill its operational and legal requirements, including:

  • Active account management
  • Campaign history logs
  • Platform analytics

Inactive or unverified accounts may be deleted after 12 months of inactivity. Aggregated or anonymized data may be retained for longer periods for analytical purposes.

12. Data Security

AmberAds implements commercially reasonable measures to safeguard user data, including:

  • Encrypted data storage
  • Network and server security controls
  • Access control and authentication policies

While reasonable efforts are made, no method of transmission or storage can be guaranteed as completely secure.

AmberAds reserves the right to restrict, suspend, or revoke access to any user account at its sole discretion in cases where suspicious or potentially fraudulent activity is detected.

The platform may conduct investigations for an unspecified duration, and during such investigations:

  • Account access may be limited or temporarily disabled
  • Campaign participation may be suspended
  • Platform funds may be frozen until investigation is concluded.

    If fraudulent activity is confirmed, AmberAds may return affected balances to the advertiser, at its discretion.

If it is determined that a user is under the age of 16, AmberAds reserves the right to immediately freeze the account and all associated balances. Refund of the remaining balance will only be made to a verified legal guardian, upon provision of sufficient documentation and identity verification.


13. User Rights and Limitations

AmberAds does not currently provide users with the ability to request:

  • Access to personal data
  • Modification or correction of personal data
  • Erasure ("right to be forgotten")

We do not claim or ensure compliance with regulations such as:

  • GDPR (EU)
  • CCPA (California)
  • UK GDPR, LGPD, PIPEDA, or equivalent laws

    The AmberAds platform is not intended for use by individuals located in jurisdictions that mandate compliance with such laws. By using the platform, users confirm they are not subject to such regulations.

14. Children’s Privacy

AmberAds is not directed at or intended for use by individuals under the age of 16. We do not knowingly collect personal data from minors. If we become aware of such data being collected inadvertently, it will be promptly deleted.

15. Platform Limitations

AmberAds operates within the boundaries of the Telegram ecosystem. By using AmberAds, users also agree to Telegram’s own privacy policies and platform restrictions.

AmberAds does not guarantee ad visibility, campaign success, or specific engagement levels. All actions are at the user’s own discretion and risk.

Users are solely responsible for complying with Telegram’s community guidelines and platform terms. AmberAds shall not be held liable for any actions taken by Telegram against a user's account or channel as a result of violations of its rules.


16. Modifications to Terms

AmberAds reserves the right to update, revise, or otherwise modify this document at any time. Changes will be communicated via platform interfaces. Continued use of the service constitutes acceptance of the updated terms.

18. Legal Disclaimer

AmberAds is provided "as is" and "as available" without warranties of any kind. Use of the service is at the user's sole risk. AmberAds shall not be liable for any direct or indirect damages arising from platform usage, campaign outcomes, or publisher performance.
